Request for information - Malvern Hills Acts

Malvern Hills Trust (the working name of Malvern Hills Conservators) is considering the promotion of a Bill in the current session of Parliament.

If the Bill is promoted, it is likely to provide for the repeal of existing legislation relating to land under the Trust’s jurisdiction, with much of the legislation being re-enacted in modern language.

Some of the provisions that would be repealed by the Bill make provision about specific land or the owners of specific land.

In some cases, the Trust will need to serve notices on people or bodies (if any) who currently benefit from those provisions and the Trust is carrying out its own investigations into their identity.  

To assist those investigations, the Trust is interested in hearing from any person or body who is or claims to be:

  • the owner of any land or interests in land (including interests as Lord of the Manor) within the area shown on the map referred to at the end of this notice
  • in particular, any successor in title to land shown on that map and which was owned in 1884 by John Vincent Hornyold and Thomas Charles Gandolfi Hornyold
  • the successors in title of Lady Emily Foley or Sir Henry Foley Grey, Baronet, to land or interests in land in the parish of Malvern, or the lessees, tenants or grantees of those successors in title.

The particular provisions of the Malvern Hills Acts which are relevant are sections 13, 20 and 25 of and Schedule 3 to the Malvern Hills Act 1884 and section 8 of the Malvern Hills Act 1909.

The Malvern Hills Act 1884 and the Malvern Hills Act 1909 and the map referred to above can be viewed on www.malvernhills.org.uk/looking-after/malvern-hills-acts.  The map shows relevant parts of the land which is under the jurisdiction of the Trust.
